FINANCIAL SETTLEMENTS
Financial clean break - a court order to end all the financial claims either spouse may have against the other, arising out of the marriage and upon death.
Spousal Maintenance - save for short duration marriages where there are no children, the question of whether spousal maintenance is payable and in which circumstances becomes very important. We are able to advise and assist you in this problematic area.
Pension - Since July 1996 the court has had the power to apportion a pension and as of December 2000 the Court has also had the ability to split a pension. Accordingly, the value of a spouse's pension has become an important factor in looking at a financial settlement. We are able to advice (with the benefit of experts if appropriate) a way though this complicated and growing area of law.
Child Matters - both parents have a duty in law to support their children. Since the introduction of the Child Support Act the Court, in the majority of cases, is no longer able to make mandatory orders. In these cases the Court only has the ability to make orders if the parties agree. Otherwise, maintenance for children is resolved by agreement between the parents or the parent with residence of the children applies to the CSA. We are able to advise and assist as to the best way to deal with this area.
